Whistleblowers' Rights in the Context of Personal Data Protection

The Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR) and Act No. 54/2019 Coll. on the Protection of Whistleblowers of Anti-Social Activities (hereinafter referred to as the "Whistleblowers Protection Act") guarantee whistleblowers the protection of their personal data, granting the following rights:


1. Right to Anonymity and Confidentiality

  • You have the right to have your identity as a whistleblower remain confidential and anonymous unless otherwise required by law.
  • If it is necessary to disclose your identity, you must be informed in advance, and appropriate measures must be taken to protect you from potential consequences.

2. Right to Restrict Processing of Personal Data

  • As a whistleblower, you have the right to request that the processing of your personal data is limited to the purposes necessary for investigating your report.
  • The data controller may process your data only with your consent, or if it is required to protect the rights of another person, the public interest, or to assert or defend legal claims.

3. Right to Protection Against Retaliation

  • You have the right to protection against any retaliatory actions arising from your report.
  • If your personal data is leaked or misused, you have the right to seek redress and protection from further negative consequences.

4. Right to Access Personal Data

  • You have the right to know which personal data is being processed about you in connection with your report and who has access to it.
  • This includes the right to be informed about how your data is protected and secured against unauthorized access.

5. Right to Rectification of Personal Data

  • You have the right to request the correction of inaccurate or incomplete personal data being processed about you in connection with your report.

6. Right to Erasure of Personal Data (“Right to Be Forgotten”)

  • After the investigation of your report is concluded, you have the right to request the deletion of your personal data unless its further retention is required for other lawful purposes.

7. Right to Lodge a Complaint

  • If you believe your rights as a whistleblower have been violated, you have the right to file a complaint with the Office for Personal Data Protection of the Slovak Republic or another competent authority.

These rights are designed to ensure the protection of whistleblowers so they can report unlawful or unethical conduct without fear of retaliation, while also guaranteeing the safeguarding of their personal data.
